That is definitely one of the immature things that some people do on the internet. It is not worth the time and effort and potential legal issues.

Isn't it because there are too many people using the server?

Most sites don't suddenly become flooded with connection requests at the same time

And even the ones that do like firesharing and youtube would have extra servers to lessen the load
